TOUR CONDITIONS & CONSUMER DISCLOSURE NOTICE

To our customers: Please read these conditions and disclosure in their entirety.  IT IS IMPORTANT.

Air Transportation: These tours are designed for travel on any air carrier.  All air transportation in conjunction with these programs must be arranged through Golf Getaways directly.  There will be a $25.00 per person service charge for reservations without domestic flight arrangements, and a $100.00 per person service charge for reservations without international flight arrangements.

Baggage Allowance: Baggage allowance on airlines is either two pieces of checked baggage or one piece and a golf bag, in addition to one piece of regulation carry-on hand luggage per person. There is a 50lbs weight restriction on bags for domestic and international travel.

Taxes: Taxes are included on the land arrangements as indicated in the individual programs.

Visas: Some countries around the world require visas for entry and it shall be the sole responsibility of the traveler to ensure that he or she obtain such visas.  Golf Getaways will be available to assist in such efforts if requested.

Tour Prices: Tour prices quoted herein are in effect as of January 1, 2007 and are subject to change by any purveyor involved without notice.

Rental Cars in Hawaii: Unless otherwise noted within, tour prices include rental of 4-door compact sedan with unlimited mileage for 4 or 7 days, respectively, for 4 and 7 night tours.  All rentals are for consecutive 24-hour periods.  Any additional rental time charges are the responsibility of the passenger.  The daily state tax surcharge is not included.

Not Included in Tour Cost: Airfares; meals, tips and sightseeing other than specified; telephone calls; room service; any items of a personal nature; and items not specified in the itinerary or features.

Deposit and Payment: A deposit in the amount of $200 per person is due upon reservation of the tour.  Reservations will not be held without the deposit.  Full payment is due 45 days prior to departure.  Credit card payments are subject to 3% handling charge.

Cancellations and Refunds: HAWAII and other trips within the United States: Once a tour has been booked there will be a $50.00 charge per person for any cancellation.  There will be a $25.00 per person charge, per change in reservations after deposit.  Cancellations received less than 30 days before departure and cancellations of documented bookings are subject to a $100.00 per person charge. Additionally, a lodging charge of 2 nights accommodations will apply if cancellation is received within the last 14 days before departure.  Once a tour has begun there will be no refunds made for any unused or partially used tour features or services, including lodging.  In all cases, cancellation fees will apply and are non-refundable for any reasons, including sickness or other emergencies. 

For bookings on international tours, the cancellation fee is $200 per person once the trip has been booked and cancellations received less than  60 days prior to departure are subject to a 100% cancellation fee unless Golf Getaways is able to recover any funds from hotels, local tour operators or other entities that would have received funds in advance.

 Golf Getaways reserves the right to cancel any tour prior to departure for any reason.  Should this happen, refunds will be made without obligation.  All airline tickets, when issued, except for first class travel, carry cancellation or change penalties assessed by each individual airline.  Once the tickets are issued, the passenger becomes responsible for the penalties.

Disclosure Notice:

Golf Getaways Ltd. is acting as intermediary and agent for suppliers identified on the attached or accompanying documents in selling services, or in accepting reservations or bookings for services that are not directly supplied by this travel agency (such as air carriage, hotel accommodations, ground transportation, meals, tours, cruises, etc.).  This agency, therefore, shall not be responsible for breach of contract or any intentional or careless actions or omissions on the part of such suppliers, which result in any loss, damage, delay, or injury to you our your travel companions or group members.  Unless the term "guaranteed" is specifically stated in writing on your tickets, invoice, or reservation itinerary, we do not guarantee any of such suppliers' rates, booking, reservations, connections, scheduling or handling of personal effects.  

The travel agent shall not be responsible for any injuries, damages or losses caused to traveler in connection with terrorist activities, social or labor unrest, mechanical or construction difficulties, diseases, local laws, climactic conditions, abnormal conditions or developments, or any other actions, omissions or conditions outside the travel agent's control.  By embarking upon his/her travel, the traveler voluntarily assumes all risks involved with such travel, whether expected or unexpected.  Traveler is hereby warned of such risks and is advised to obtain appropriate insurance coverage against them.  Your retention of tickets, reservations or bookings after issuance shall constitute a consent to the above and an agreement on your part to convey the contents herein to your travel companions or group members.  Changes in the itinerary are not likely, however, Golf Getaways reserves the right to make such changes if necessary for the comfort or safety of the passengers, or due to circumstances beyond our control. Golf Getaways reserves the right to decline to accept or retain any person on any tour as a member either for the whole tour or any part thereof.  The IATA of ARC airline carriers, together with Golf Getaways and/or its ground  operators, are not to be held responsible for any act, omission or event during the time passengers are not on board their planes or conveyances.  The passage contract in use by the airlines concerned, when issued, shall constitute the sole contract between the airlines and the tour passengers.

Any and all disputes concerning this contract or your trip shall be resolved solely and exclusively by binding arbitration according to the then current rules of the American Arbitration Association in Bend, Oregon, and any such arbitration must take place in Bend, Oregon. In any such arbitration, the substantive law of Oregon will apply.
